These Terms of Service ("Terms") are a legal agreement between you and Milan Matić Preduzetnik (registered as MILAN MATIĆ PREDUZETNIK BEOGRAD - PALILULA), a registered sole proprietor (preduzetnik) in the Republic of Serbia ("we", "us", "our"), operating the Seasona mobile application (the "App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

Seasona analyzes a photo of you to suggest a personal color season and a palette of colors, along with related style suggestions (such as recommended makeup shades, metals, and colors to favor or avoid).
Seasona provides style and aesthetic guidance for informational and entertainment purposes only. It is not professional advice of any kind. Color analysis is inherently subjective, and results reflect a categorization method, not a scientific, medical, or objective fact about you. Different methods, lighting conditions, or human stylists may reach different conclusions. You should treat Seasona's output as a helpful starting point and personal preference guide — not as a definitive or guaranteed result.
You are solely responsible for any decisions you make (including purchases of clothing, makeup, or other products) based on the App's suggestions.
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the App. By using the App, you represent that you meet this requirement and that you have the legal capacity to agree to these Terms.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your own personal, non-commercial use, in accordance with the Apple Media Services Terms and Conditions and the App Store's Licensed Application End User License Agreement (EULA) (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).

You are responsible for the photos you choose to analyze. You confirm that you have the right to use any photo you provide to the App and that doing so does not violate anyone else's rights. As described in our Privacy Policy, your photos are analyzed on your device and are not uploaded to us.
The App offers optional paid features ("Premium") through in-app purchases, which may include auto-renewing subscriptions and/or one-time (lifetime) purchases. All purchases are processed by Apple through your Apple ID, and are subject to Apple's terms.
For auto-renewing subscriptions, you acknowledge and agree that:
Refunds are handled by Apple in accordance with Apple's policies. We generally cannot issue refunds directly; please request refunds through Apple (https://support.apple.com/billing).
Price changes: we may change subscription prices for future billing periods. Where required by Apple or by law, you will be notified and, where applicable, asked to consent before a price increase takes effect.
EU/UK right of withdrawal: if you are a consumer in the EU/EEA or UK, you may have a statutory right to withdraw from a purchase within 14 days. By starting to use a digital purchase immediately, you may be asked to acknowledge that you lose this withdrawal right once the content is delivered/accessed, to the extent permitted by law. Statutory consumer rights that cannot be waived are not affected by these Terms.
The App, including its software, design, text, graphics, color datasets, palettes, and branding, is owned by us or our licensors and is protected by intellectual-property laws. Except for the license granted in Section 3, these Terms do not grant you any rights in the App or its content. "Seasona" and our logos are our marks; you may not use them without our permission.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law.
Without limiting Section 1, we do not warrant that:
Because results depend heavily on photo quality and lighting, and because color analysis is subjective, results may vary and should not be relied upon as definitive.
To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the App — including any decisions or purchases you make based on the App's suggestions.
To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising out of or relating to the App or these Terms will not exceed the greater of (a) the amount you paid us (via Apple) for the App in the twelve (12) months before the claim, or (b) USD 50 (or its equivalent).
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.
To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your misuse of the App, your violation of these Terms, or your violation of any rights of another person (including analyzing someone else's photo without consent).
We may modify, suspend, or discontinue the App (or any feature) at any time. We may also update these Terms from time to time; the "Last updated" date will reflect changes, and material changes will be notified where required. Your continued use of the App after an update means you accept the revised Terms.
You may stop using the App at any time. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive.
These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-laws rules. If you are a consumer, you may also benefit from mandatory provisions of the law of the country in which you reside, and nothing in these Terms deprives you of the protection of those provisions.
Your use of the App is also subject to Apple's terms, including the Apple Media Services Terms and the standard EULA referenced in Section 3. Apple is not a party to these Terms, but Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple has no obligation to provide support or maintenance for the App.
